Welcome to Elysium, a Layer-1 blockchain project developed by Vulcan Forged ("Vulcan Forged," "we," "us," or "our"). By accessing and using Elysium, you agree to be bound by these terms and conditions of use (the "Terms"). Please read these Terms carefully before using Elysium. If you do not agree to these Terms, you may not access or use Elysium.

Acceptance of Terms

By accessing and using Elysium, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use Elysium.

Eligibility

To access and use Elysium, you must be at least 18 years of age and not be barred from using Elysium under any applicable law.

License

Vulcan Forged grants you a limited, non-exclusive, non-transferable, revocable license to access and use Elysium for your personal and non-commercial use.

Ownership

Elysium, including all intellectual property rights therein, are owned by Vulcan Forged and its licensors. You acknowledge and agree that you have no right, title or interest in or to Elysium except as expressly granted in these Terms.

Prohibited Conduct

You agree that you will not engage in any conduct that:

  • (a) violates any applicable law, regulation or rule;
  • (b) infringes the rights of Vulcan Forged or any third party, including intellectual property, privacy, publicity or other proprietary rights;
  • (c) is defamatory, libelous, abusive, threatening, harassing, vulgar, obscene, pornographic or otherwise objectionable;
  • (d) constitutes unauthorized or unsolicited advertising, junk or bulk email, or any other form of unauthorized solicitation;
  • (e) interferes with the operation of Elysium or any other user's enjoyment of Elysium;
  • (f) introduces viruses, worms, or other harmful code;
  • (g) alters, damages or destroys any information, data, or Elysium or any component thereof;
  • (h) violates any applicable export control laws or regulations.
Disclaimer of Warranties

Elysium is provided "AS IS" and without warranty of any kind. Vulcan Forged expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including without limitation, any warranty of merchantability, fitness for a particular purpose, title, non-infringement, or any warranty arising from the course of dealing or usage of trade.

Limitation of Liability

To the maximum extent permitted by applicable law, Vulcan Forged and its affiliates, directors, officers, employees, agents, or licensors shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or damages for loss of profits, revenues, goodwill, use, data or other intangible losses, arising out of or in connection with Elysium, whether based on contract, tort, strict liability or any other legal theory, even if Vulcan Forged has been advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold Vulcan Forged and its affiliates, directors, officers, employees, agents, or licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your use of Elysium.

Modifications

Vulcan Forged reserves the right, at its sole discretion, to modify or replace these Terms at any time without prior notice. Your continued use of Elysium following the posting of any changes to the Terms constitutes your acceptance of such changes.

Termination

Vulcan Forged may, in its sole discretion, terminate or suspend your access to Elysium at any time, without notice and without liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore, without giving effect to any principles of conflicts of law. You agree to submit to the personal jurisdiction of the courts located in Singapore for the purpose of litigating all such claims or disputes.

Entire Agreement

These Terms constitute the entire agreement between you and Vulcan Forged regarding the use of Elysium, and supersede all prior agreements and understandings, whether written or oral, regarding the subject matter of these Terms.

Waiver and Severability

The failure of Vulcan Forged to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Assignment

You may not assign these Terms or any of your rights or obligations hereunder, whether by operation of law or otherwise, without the prior written consent of Vulcan Forged. Vulcan Forged may assign these Terms or any of its rights or obligations hereunder without your prior written consent.
